SSDI Benefits in New York

The Social Security Disability Insurance program (SSDI) is a federal disability income assistance program for those unable to work due to a permanent injury or disability. Those who meet the requirements may apply for benefits, including medical coverage and other financial compensation benefits.

To qualify, a person must be:

  • Unable to work because of their medical condition
  • Unable to do the same work they did before the injury or disability
  • Unable to adjust to a different work environment
  • Expected to remain disabled for at least one year or have a terminal diagnosis

Those who meet all of the above criteria may pursue SSDI benefits. It is important to note that applying to this program takes time, and the Social Security Administration requires extensive documentation and medical records to verify each applicant.

Social Security Disability Hearing

After applying to the SSDI program, the applicant must attend a Social Security Disability hearing. An Administrative Law Judge and a secretary will be present to hear the case at the hearing. The applicant and their legal representative must present medical records and evidence to the court showing that the applicant is disabled and cannot work as they did before the injury.

These hearings are small, but they are a crucial part of the application process. Only about half of all applicants receive approval after the hearing, so you must entrust your case to an experienced legal professional.

Committed To Helping You Obtain Your SSDI Benefits

We know that applying for Social Security Disability can be a confusing process. We provide a thorough review of your situation to determine the benefits that are available to you.

These possible benefits include:

  • SSDI benefits for clients unable to work due to injury or illness
  • Supplemental Security Income (SSI) — benefits paid to individuals who may not qualify for SSDI or need additional income due to disability
  • A disabled child or disabled widow benefits
  • Social Security Disability benefits and workers' compensation offset

Each type of benefit has specific criteria that must be met before being awarded. Our attorneys will walk you through the process. We assemble all the medical information and documentation necessary to support your claim.

Many Social Security applicants will need to appear at a hearing before being granted benefits. Our attorneys will appear on your behalf at hearings and present a compelling case so you can receive the benefits to which you are entitled.
