New York workers’ compensation laws require your employer to provide two basic benefits to you when injured on the job: medical benefits and monetary benefits.
An injured worker is entitled to receive cost-free necessary medical care from an authorized Workers’ Compensation Board doctor for all injuries directly related to your accident. There are no copays when you see the doctor.
This medical coverage includes any emergency room treatment or urgent care you receive immediately following your accident. You should not have to pay out of pocket for your injuries.
Ongoing medical care that may be covered under workers’ compensation includes doctor’s examinations, surgery, physical therapy, chiropractic care, MRIs, EMG/NCS, medications, injections, etc. Medical treatment costing less than $1,000 does not need preauthorization. However, insurance companies will try to deny paying for your treatment unless the proper forms are correctly filled out in a timely manner.

If you are out of work for more than seven days due to work-related injuries, you may be entitled to receive money to make up for your lost wages. The maximum amount an injured worker can receive each week is calculated based on your average weekly wage and your percentage of disability. Your average weekly wage is determined by the 52 weeks of your payroll prior to your accident, including any overtime for which you’ve been paid.
Since workers’ compensation is an incentive system, if an injured worker returns to work part time, light duty or to a different position making less money because of his or her disability, then he/she may be entitled to 2/3 of the difference between pre-accident earnings and post-accident earnings.
